These Terms of Sale apply when you purchase products through www.basfoods.com.au.
The online store is operated by Basfoods Direct Pty Ltd as trustee for the Basfoods Direct Unit Trust, trading as Basfoods Direct.
By placing an order, you agree to these Terms of Sale and our:

1. Placing an order
When you place an order, you are offering to purchase the selected products for the prices and charges displayed at checkout.
You must provide complete and accurate contact, delivery and payment information.
An order is accepted when we send you an order confirmation. We may contact you if we cannot accept or fulfil all or part of your order.
2. Prices and payment
Prices are displayed in Australian dollars and include GST where applicable.
Delivery charges and other applicable fees will be displayed before you complete payment.
Payment must be made using one of the payment methods available at checkout. Payments may be processed by Shopify Payments or another payment provider.
We may correct an obvious pricing or product-information error. If an error affects an order you have placed, we will contact you and provide the option to proceed on the corrected terms or receive a refund.
3. Product availability
Products are subject to availability.
If a product is unavailable after you place an order, we will notify you and refund the amount paid for that product. Where appropriate, we may offer a substitute, but we will not provide it without your agreement.
Product packaging, appearance and information may change from time to time. Images are provided as a general guide, and colours may appear differently depending on your device.
4. Product information and allergens
We take reasonable care to provide accurate product descriptions and information.
Product ingredients, nutritional information and allergen declarations may be updated by manufacturers. You should always read the label and instructions on the product before consuming or using it.
If you have an allergy, intolerance or other dietary requirement, check the product label carefully and contact us before purchase if you require further information.
5. Delivery
We deliver only to the locations described in our Delivery Information.
Delivery dates and times are estimates unless we expressly agree otherwise. Delays may occur because of events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address and ensuring someone can receive the order where required.
We are not responsible for a failed or delayed delivery caused by incorrect information you supplied. Additional delivery costs may apply if an order must be redelivered because of incorrect details or your failure to receive it.
Responsibility for the products passes to you when they are delivered to the address provided with your order.
6. Order changes and cancellations
Contact us promptly if you wish to change or cancel an order.
We are not required to change or cancel an order after it has been accepted or prepared for dispatch. If we agree to a cancellation, we will refund the applicable amount using the original payment method.
We may cancel all or part of an order if:

a product is unavailable;

payment cannot be processed;
-
information on the website is materially incorrect;

we cannot deliver to the supplied address;

order limits have been exceeded; or
-
we reasonably suspect fraud, resale abuse or unlawful activity.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled products.
7. Returns and refunds
Returns, replacements and refunds are handled according to our Returns and Refunds Policy.
We do not provide refunds or exchanges because you change your mind, order the wrong product, find it cheaper elsewhere or decide you no longer want it.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
8. Consumer guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a replacement or refund for a major problem and compensation for other reasonably foreseeable loss or damage. You may also be entitled to have a product repaired or replaced if it is not of acceptable quality and the problem is not major.

9. Accounts
You are responsible for maintaining the confidentiality of your account details and for activity conducted through your account.
You must provide accurate information and notify us promptly if you believe your account has been accessed without permission.
We may suspend or close an account if it is used fraudulently, unlawfully or in serious breach of these Terms.
10. Promotions and discount codes
Promotions and discount codes are subject to any conditions stated with the offer.
Unless otherwise stated:

a discount code cannot be exchanged for cash;

only one discount code may be used per order;

a discount cannot be applied after an order has been placed; and
-
a promotion is available only during its stated period and while relevant stock remains available.
11. Liability
We do not exclude or limit liability where doing so would be unlawful, including liability arising under the Australian Consumer Law.
To the extent permitted by law, we are not responsible for loss caused by:

your misuse, mishandling or incorrect storage of a product;

inaccurate information you provide;

events outside our reasonable control; or
-
use of a product contrary to its label, warnings or instructions.
12. Changes to these Terms
We may update these Terms from time to time. The Terms applying to an order are those published when the order is placed.
13. Governing law
These Terms are governed by the laws of Victoria, Australia. The courts and tribunals of Victoria have non-exclusive jurisdiction.
